If you file as a small business (doing business as), you are subject to the same requirements, restraints and jurisdiction as other Chapter 13 debtors. There is, however, some additional reporting required. You may be required to file periodic reports and summaries of your business operations with the Chapter 13 Trustee and with the Court. Make sure to contact your attorney if you have any questions. You should have prepared a summary of income and expenses for your business and include that information in your Statement of Financial Affairs. Your attorney will have the proper forms to file with your Petition and Schedules IF you have advised your attorney of the business at the time of your initial consultation. If for any reason you have not so advised your attorney, do so now. This information is important to the confirmation of your plan and must be provided to the Trustee immediately.
